The filmmaker Ava DuVernay's 2016 documentary*13th* made a powerful
historical claim pithily encapsulated in its subtitle: "From slave to
criminal in one amendment." The argument goes like this: The 13th
Amendment's so-called "exception clause," which outlawed slavery "except as
a punishment for crime whereof the party shall be duly convicted,"
effectively converted race-based slavery into race-based incarceration.
That thesis has fascinated amateur history buffs, motivated activists, and
given rhetorical ammunition to politicians like Bernie Sanders, who

that, "due to an extreme shortage of labor caused by the emancipation of
slaves, former Confederate states exploited the legalization of penal labor
by incarcerating newly freed black people.” And it forms an important plank
of *The New York Times Magazine'*s *1619 Project*, in which Bryan Stevenson
writes that "after emancipation, Black people, once seen as less than fully
human 'slaves,' were seen as less than fully human 'criminals.'"

The problem, according to the Howard University historian Daryl Michael
Scott, is that it's just not true. Scott, in an essay in

coins the term "thirteentherism" to describe what he says is a fundamental
misconstrual of the historical record. The basic theory, Scott says,
originated not with academics but with incarcerated activists. Lee Wood, a
California prisoner and later founder of the Coalition Against Prison
Slavery, first promulgated the notion that the exception clause was used to
functionally re-enslave freed Blacks, and that it continued to ramify into
the present. Other activists picked up the idea, where it eventually
migrated into academe and popular consciousness. "Thirteentherism," Scott
writes, "is best viewed as another episode in a long tradition of using
history as a weapon in a political struggle. At times, the distinction
between historical truth and propaganda gets lost."

Harvard's refusal is part of a longstanding pattern of denying tenure to
activist-scholars: "Harvard has a problem with outspoken, principled
faculty who take public positions that question university policy,
challenge authority, or might ruffle the feathers of big donors." (And
